General terms and conditions of sale

These conditions are applicable to all sales concluded with the hotel L'Espadon, 8 avenue de la forêt 85160 Saint Jean de Monts. The customer hereby acknowledges having read these general conditions of sale and undertakes to comply with them.
These conditions of sale may be modified at any time, and the conditions applicable will be those in force on the date the reservation is made.

ARTICLE 1 - PRICES
The prices shown are in €uro and include VAT applicable on the day of booking. Any change in the applicable rate, or any modification or introduction of new legal taxes introduced by the competent authorities, will be automatically reflected in the prices indicated on the date of invoicing.
Rates are per room for the number of people indicated and according to the period selected and do not include other services (unless otherwise stated).
The tourist tax is not included in the price and must be paid directly on site. The conditions of application are determined by the Mairie de Saint Jean de Monts.
Certain services may be subject to a supplement and to possible changes without prior notice, for which the hotel cannot be held responsible.

ARTICLE 2 - RESERVATIONS AND MEANS OF PAYMENT
Reservations can be made on the sites, by telephone, by e-mail or by post, or directly at reception.
The reservation will only be effective if it is guaranteed by the customer, either by providing a credit card number with a validity date or by paying a deposit (cashed).
Payment for all services must be made directly to the hotel (except for reservations prepaid at the time of booking and if the validity date of the credit card is prior to the date of arrival).
The hotel reserves the right to refuse any reservation if the credit card number is incorrect or the reservation incomplete.
Reservations from all sources are payable in €uro only.
Our hotels accept the following credit cards: Visa and Mastercard, and has a secure reservation system (SSL) which protects and encrypts all sensitive data transmitted to the reservation in order to prevent any disclosure to a third party.
The customer is solely responsible for their choice of services and their suitability for their needs, and L'Espadon cannot be held liable in this respect.

ARTICLE 3 - FORCE MAJEURE
Force majeure is understood to mean any event outside the control of the parties that is both unforeseeable and insurmountable, and which prevents the customer from carrying out all or part of the obligations set out in the contract. This applies in particular to strikes involving means of transport, hotel staff or government or public riots.

 ARTICLE 4 - MODIFICATION AND CANCELLATION OF STAY
Any modification or cancellation of a booking must be requested by email to info@hotel-espadon.com or by post.
- Cancellation made before 2 days before the date of arrival: €25 handling charge per room.
- Cancellation made within 2 days of arrival: the 1st night will be charged per room.
- In the event of a reduced stay: €25 handling fee will be charged per room.
Pre-1st, last-minute and package bookings are made in advance and are non-refundable, non-exchangeable and non-cumulative.
For bookings made via our partners' websites, cancellations must be made via this website. The cancellation conditions that apply are specific to the partner and may therefore differ from those of our hotels.
If you wish to extend your stay, you must notify reception no later than the day before your planned departure, in order to check availability.

ARTICLE 5 - ARRIVAL AND DEPARTURE
Rooms are available from 4 p.m. and must be vacated by 11 a.m. on the day of departure. A supplement may be charged if the maximum check-out time is not respected. In the event of arrival after 7 p.m., reception must be notified.

ARTICLE 6 - ACCOMMODATION
In the event that the hotel is not available or in the event of force majeure, the hotel reserves the right to accommodate the customer, in whole or in part, in a hotel of equivalent or higher category, offering services of the same nature.

ARTICLE 7 - COMPLAINTS
All complaints must be sent by recorded delivery letter within 15 days of the departure of the holiday that is the subject of the complaint. After this period, no complaint can be taken into account.

ARTICLE 8 - INFORMATION TECHNOLOGY AND CIVIL LIBERTIES
In application of the French Data Protection Act 78-17, customers are informed that their reservation is subject to computerised personal data processing. Users have the right to access and rectify the data entered, which may be exercised by contacting the head office: SARL L'ESPADON, 8 avenue de la forêt 85160 Saint Jean de Monts. Please note that this information will not be passed on to third parties.
Our hotels offer wifi internet access. The customer-user undertakes to ensure that the computer resources made available to him/her will not be used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects protected by copyright or neighbouring rights, such as texts, images, photographs, audiovisual musical works, software and video games, without the authorisation of the holders of the rights provided for in Books I and II of the Intellectual Property Code, where such authorisation is required.

ARTICLE 9 - ANIMALS
Dogs are accepted (vaccination up to date) in our establishments for a supplement/night/pet, not fed. Under no circumstances may pets be left alone in the room and must be kept on a lead in communal areas.

 ARTICLE 10 - LIABILITY
The hotel declines all responsibility in the event of theft, loss or damage to guests' belongings during their stay.
We remind you that, as a public place, all the premises are entirely non-smoking (including electronic cigarettes). Smoking in a public area may result in a fixed fine of €68 or prosecution.
The customer will be held responsible for any damage, deterioration or act of vandalism that may occur as a result of occupying the premises and/or as a result of the participants and/or the staff and/or the animal for which he/she is responsible, as well as other customers, movable, decorative and immovable property belonging or not belonging to the hotel. As a result, the hotel may ask the client to leave the establishment without any compensation or reimbursement for the stay in progress, and to reimburse any damage caused by his/her actions.

ARTICLE 12 - APPLICABLE LAW
These General Terms and Conditions of Sale are governed by French law.  This applies to both substantive and formal rules. Any disputes will fall within the exclusive jurisdiction of the French courts.
